警察庁『漫画・アニメ・ゲーム表現規制法』

本日、同人作家のお友達から、日本国内で、再びネット、ゲームや漫画を法規制する動きがあるということを知らされました。

日本が世界に誇れる文化であるマンガやアニメ、 また、同人作家のみなさんが何よりも打ち込んでいるものを守ることに是非協力したいと思います。
表現の自由があるからこそ、良い作品は生まれます。たくさんのクリエイターの生きがいである作品作りが法規制されることのないよう、このことについて知り合いや友達に伝えて頂けると嬉しいです。

また、日本と海外の同人情報を提供し、世界のクリエイターを結ぶことがゴールのAKIBA ANGELSとして何ができるか、と考えたところ、やはり日本の作品を愛してくれているたくさんの海外の方々に、この規制について知らせ、日本のクリエイターの自由を守ることに支援して頂けるよう、著名を集めたいと思いました。

この掲載を見ていただいた日本の皆様も、著名のつもりで是非一言コメントを残して頂ければ嬉しいです。

今、ネット、ゲームや漫画の影響で犯罪が起きるから、 とそれらの過激な表現を規制しようという動きがあります。 そのために先日、警察庁の検討会が開かれました。

しかし今までゲーム等の影響で犯罪が増えた、という統計データは無く、 このままでは一方的な偏見でネット、漫画やアニメ、ゲームが法規制されてしまいます。

I am very much against censorship, especially when it comes to art. I do not believe artistic representations of nude characters contribute in any way to sexual crimes within or outside of Japan, and would like to say that I support the artists of these images for depicting realism (in that all humans shower or bathe nude) and/or expressing their sexual fantasies in a healthy manner, rather than actualizing them.

I don't think it's the National Police Agency's place to shield the public from images in the media. I think it's the parents job to teach their children proper morals and values so they can handle what the world offers them, reasonsibly.

I cannot believe this. These genres have been so popular for so long in Japan. What's the reason to suddenly criminalize them? We have similar absurd laws in Holland though...

I dont like childporn all that much either but heck..
Teenage characters of 15 and over would be an appropriate level i think when it comes to hentai.
You cant really strech out a character's background and or warm up to them if they are already , ready for college all the time..
At least some school life while their at the start of or midterm of highschool years or other . those typ of hentai give very good teen anatomy for reference.
one of many reasons as to why i enjoy hentai is that i learn from it to improve my own skill's in drawing. as well as the presonality for character development.

Yes, child pornography is wrong and pretty bad, but this is going alittle bit too far-- Different artists have different styles, and some artitsts draw their characters "cuter" than others...as in, a character may be 18 in the story, but may not look it--that doesn't make it illeagle :/ I am an artist myself and My characters look quite young for their age...we shouldn;t be forced to change our style.
Thurther more, I wouldn't like a very very young person-kind-of-comic....but I don't think 15/16/17 is bad at all, if put in the right context.

Japan is practically the last bastion for complete artistic freedom. (US as well, but that seems to be changing now.) I hope this law doesn't pass.

Of course, I support the Japanese artists and their endeavors.

Please let us know how the law goes in the future. (I assume that the conclusion for the new law would take a while, though.)

Assuming that drawn material can influence someone to do sexual crimes is an example of how incredibly retarded humans can be as a whole society.

Most people have largely enough common sense to keep it all as fantasies, and those who are deranged enough to sexually assault someone else would do it even if you would censor every digital material in the world.

While I believe arguing that art should be untouchable is not very convincing in itself, if this art does not harm anybody who isn't already mentally ill (and no art can ever do that), then censoring it would be an outrageous insult to the people's intelligence.

Furthermore, I would like to add that this 18 years old age limit is silly, unflexible and illogical. I would say anyone is sufficiently developped to view this sort of content at age 14, and some people even sooner, given competent parenting.

To conclude, censorship is a pointless act of terrorism against every artist's freedom of speech and expression, and should be avoided at all costs. Efforts should rather be concentrated into limiting the distribution of these kind of files to people who can watch, and 18 years old seems like a pretty illogical limit to me.

2. Japan, while allowing this type of artwork, enjoys a lower rate of crimes against children than other indusrtrialized countries where such artwork is forbidden. Therefore the premise that this type of artwork leads to crimes is faulty

It's quite wretched to censor art like this. Especially when the audience reading these comics or appreciating the art are usually over the legal age to look at real life pornography.
At the end of the day it's not real, it's just art and artists styles vary greatly.

I live in Japan over the summer, and although I don't support child pornography, I think the display of such art would cause no harm to anyone. The minors still are not allowed to view such material and this should be more of an freedom of expression. I seriously bet, that if this law is past, the crime rates would only increase since the criminals cannot vent their stress/desires elsewhere. At least, that's what me and my friend say about doujin material.

When will it stop? When everything is banned! Once you censor one media it goes to the next and the next and doesn't stop. So all the families pictures have to go too? Whilst I do not agree with any form of art or media that represents sexual abuse of children I can honestly say that this law appears to have been given little thought as to its true implications. Its totally inflexible, giving no leeway for an artists style or the artworks' true subject matter which may be completely devoid of any sexual implications.

The rule about 'underhair' is rubbish, *real* people in *real* pornography shave it off because they think it looks better... are they going to censor that next?

Where I live the legal age of consent is 16. So to me the whole concept of only having depictions of people in sexual situations being 18 and over strikes me as pure lunacy.

I support artists rights to freedom of expression, the law needs dramatic rethinking to become anywhere near fair!

My full support to the Artists. Censorship artistic works is wrong, since that is rather the point of the years, or decades spent learning the skill, to get the images out of your head, and onto paper or a screen, any image that the human mind can create. To limit it is like killing a mockingbird, only harm is inflicted on society as a whole, and no good results.
No victim, no crime. The police would do better to concentrate on those who are actually harming children, and leave this as a safe and harmless outlet for people who (for whatever reason) feel they need it. Lest they, in frustration, turn to and begin to support actual child molestors.

Don't make it sound like America had anything to do with this. This is a Japanese decision plain and simple.

The world is slowly changing, and this kind of thing will keep happening until humans have no rights at all. The government controls the people because the people depend so much on the government and everyone is fine with laws that restrict our freedoms as long as they don't notice anything different. No one has the will to fight anymore. We're all destined to roll down the slope until we hit the rocky bottom. Enjoy your remaining freedoms while they last.

Without actual research data I have an extremely difficult time believing such material would increase currently criminal behaviour. How about banning movies that glorify violence or war first? Not going to happen? Great, I loved many of those movies and games anyway (and have yet to commit any act of violence).

Nudity and controversial content has long since been very popular in Japanese artistic creations, and even praised for such. If the above mentioned had anything to do with an increase in crimes then this would have occured back when BL, shota, loli, and nudity were first introduced to the Japanese society. Personally I'm not a fan of loli or shota, but to sensor nudity at all is to deny the natural way people live. The responsibility should fall on the parents for making sure that their children are taught the proper morals to cope with what is in the media. Even more basic, the parents can simply prohibit their children from watching. As for adults, they decide for themself whether to buy explicit manga or anime. No one is saying they need to or will act on what they see. Where's the proof that the crimes are connected to explicit anime and manga? I'd say you're going to have way more crime on your hands if you DO ban explicit material from the public. If you don't want to see it, then don't watch or buy it and get yourself Tivo.

Laws against art and "virtual crime" are often the most absurd. There are many relevant expressions that mix children and sexuality in art... but, ultimately, who are we to decide what's "relevant" anyways?

I fully support this signage. They said that the law will ban shotacon and lolicon. Sure, yes, those can only fuel a pedophile's interests, but not everyone has a mature type of drawing. Unless, they look extremely young [children are short, and small bodied, and obviously under developed], how can you tell if one person's style depicts an adult or not. Like Aka Tamago said, it perhaps is even better than this happening in real life.

Despite the censorship in all of their pornography and hentai there is still a great abundance of it and no one is "spared" from it because of blurs or censor bars. Firstly - under hair? Do they have any idea how early that starts developing? It is in no way a sign that someone is over 18.

We have age restrictions for some very good reasons. These are drawings intended for people mature enough to not act out what they see.

A lot of RP books have a disclaimer - 'this is not a depiction of reality and is not intended for those who are unable to tell the difference between fantasy and reality.' Maybe anime should have something similar.

If mentally ill people are harming children or being harmed by watching pornography, more resources should be put into identifying such people and caring for them.

This proposed law has no place in a modern civilised society.

Those proposing it do not understand what child pornography is. Child pornography isn't wrong because it includes sexual depictions of children or anything like that, it is wrong because it is a record of abuse. There is no comparison to be made between those who would watch a record of abuse to get their kicks, and those simply enjoying a harmless fantasy. And anybody who would compare the two is guilty of judging people they know nothing about.

This proposed law is a result of hatred and ignorance, so much so that its proposers don't seem to think they need any actual evidence! It is entirely bereft of logic or understanding. It must not come to pass.

Complete and utter rubbish. Japan is one of the only countries that enjoys more freedom than the US, and this freedom is a manifestation primarily of their comparatively narrow (and high) spectrum of living standards, which in turn is an accomplshment almost unique to that country. All one really needs to do to prevent this law from passing is point out to those involved that it will make Japan that much more like the hideous travesty that is America.

With that said, the fact remains that extant media which would be affected by this law - never mind future productions - is far, FAR too pervasive, and thus so is the mindset of the populace who produces and consumes said media. It would work about as well as outlawing alchohol. One could possibly suggest that the entire industry would be forced underground, but in fact most of it already is, isn't it. Net change: Minimal.

The fact that this law is even being proposed is indicative of somebody whose feet are so far off the ground that they probably should be extracted from office before their cancer causes some real damage.

These are depictions, not real people. They are composed of line-art, values, and sometimes hues and saturation. At what point does a line or color become "wrong"? Is it when the pen first touches paper, or is it not until the truly final stage, when the finished work is observed by someone other than the artist?

I am a struggling artist myself. I appreciate, and indeed, often emulate the anime/manga styles. For many types of characters, large eyes, pointed chins, high-set or even non-existant breasts, narrow hips, etc. are standards, regardless of the character's age. These are signs, indicators of youth, but they are also indicators (words, even, in the language of the art form) of innocence, goodness, inherent vitality and other concepts. A pixie, for example, looks strange if well endowed, with an old face, though they may well be several thousand years old in the story. And, I dislike drawing pubic hair, since I feel it detracts from the lines and makes the character seem "clunky".

It disgusts and horrifies me that a beaurocrat who cannot even differentiate between coppenhagen and perriwinkle blue feels themselves qualified to judge and silence another's voice based on nothing but a limp-wristed and impossible to prove theory, political pressure, or their own narrow-minded predjudice.

Just how do they think someone could proclaim this law without looking completely retarted. It's so blatantly disturbing thing to even consider that laws should contain words like "maybe" "might" "seem" for instance.

Even if one isn't lolicon or have interest in deciptions of underage children, they shouldn't have the right to censor it. Every censorship hurts, and the freedom of expression should never be dangered by literally dumb laws like these. Pure lunacy, I'd say.

The most laughable thing in this was the "it's underage if s/he doesn't have pubic hair. Now ever heard of shaving, have you? And for instance, go to about any local library that has Classical Arts guide/history books and even there you can find more realistic decipts of underage childs nude and what someone might consider disturbing. Heck, we had to reviews or drawings based on this topic in high school arts class and nobody complained.

A bit long post, but better than nothing and a good chance to vent my frustration on something :>

If the Japanese National Police Agency has suggested that this kind of material must be supervised and restricted if necessary, it is because many sectors of the Japanese society are truely worried about the amounts of violent pornography that is available to anyone in Japan, including minors, and they are also preocupated about the consequences that it could lead in the future.

It is not about "banning manga", since such a thing can't be done in Japa. It is about restricting and controlling the pedophile-oriented products.

So please don't be so ignorant as to say "I support" without even knowing what is the subject of matter, only selfishly thinking that the whole thing is about "banning manga".

Saying that the liberty, freedom or speech or whatever is the reason why this material must be produced and sold is defending someone's liberties but harming someone else's own liberties.

I disagree that showing someone who -appears- to be underaged in a doujinshi leads to pedastry. Come on! Anyone familiar with FMA knows Ed's hardly a -child- (The particular manga/anime I favor). It's artistic expression. Doesn't mean the artist is a child molester. In my not so humble opinion, if no living person is being abused or exploited, then the artistic expression should not be censored.

The whole reason why CP is no good is because it takes advantage of underage people. Drawings of underage people take advantage of no one, and in fact may even provide an outlet for those who would otherwise be inclined to take advantage of children.

This really harms no one; there is no reason to censor it.

Umm... I didn't notice anyone mention this point, so..

Aren't anime/manga/games (esp. manga and games) depicting sexual expression of under 18 characters so prevalent within the japanese publishing industry that a law like this would wreak havoc and shut down so many publishers/software houses that it could actually cause harm to the japanese economy? There are many popular high-distribution manga serial mags out there with many series within them that would be under scrutiny because of this law. Those anti-lolicon/shota/BL individuals posting in support of the law (as well as the Japanese politicians that introduced the bill) seem clueless to the fact of how many businesses, artists, and working people in general will be affected by this law if applied.
IMHO, the introduction of such a law will be shot down once they realize the scope of it's application, especially in it's current (very VERY) vague incarnation.

(Oh yeah... - I SUPPORT -)

And as an after thought, in Canada we already have extreme censorship on drawn depictions of sexual expression of under 18 characters, as well as ANY drawn graphical depiction of any sexual act of any age that is against the law (in writing are legally called 'Crime Comics'), so the majority of subject matter in adult manga makes the creation for sale (in regards to home grown porn comics) & importation of a huge chunk of available Jap media totally illegal. BUT Canadian law allows one such as me (if one is not a teacher or other type of reputable person of possible influence to the under18 crowd) to **** all the 14year olds girls I want (only in the reproductive way though, as sodomy is only allowed with both sexes over 18, so that means both comic form & real-life form of under18 BL sexual expression are equally illegal in Canada. Hurray for equality!)

I don't like the censorship in such art like manga, but I think that sometimes shota and loli are not the right reading. I read some of them and, considering they are fiction, I think nobody can prohibit people to read them. However, even if they don't hurt anybody, some of them can be considered child pornography.
When the content is too explicit, the mangaka draw it because he/she knows what kind of material he/she is releasing. There can be some effects.
You can tell the sexual and matural content from the pornography, especially when it's about children and teens. I think it's despicable to read this kind of manga for sexual satisfaction, as it was a porno.
